Georgia Drug Laws: When Possession Becomes a Felony

Understanding the Legalities of Drug Possession
At Davis Madden & Associates, P.C., we have a team of experienced Criminal Lawyers stationed in Atlanta who handle all types of criminal charges, including drug possession. In Georgia, the law is stringent when it comes to drug-related crimes. Depending on the type of drug, amount, and intention, charges can range from misdemeanors to felonies. Knowing what constitutes a felony can greatly aid in understanding your charges.
The Categories of Drugs in Georgia
Similar to federal law, Georgia categorizes drugs into five schedules, with Schedule I substances having the highest potential for abuse and dependency, and Schedule V estimated as the least dangerous (source).
- Schedule I: Heroin, LSD, MDMA, etc.
- Schedule II: Cocaine, Methamphetamine, Oxycodone, etc.
- Schedule III: Anabolic steroids, Codeine, Ketamine, etc.
- Schedule IV: Xanax, Valium, Ativan, etc.
- Schedule V: Robitussin AC, Lomotil, Motofen, etc.
When Does Drug Possession Become a Felony?
The seriousness of a drug charge depends on a variety of factors, including the type of drug, quantity of drug, presence of paraphernalia, previous offenses, and evidence of intent to distribute.
- Possession of Schedule I & II drugs is a felony, punishable by 2-15 years in prison for a first-time offense (source).
- Possession of Schedule III, IV, or V drugs is also a felony, but the penalties are less severe.
- Possession of a drug with the intent to distribute elevates a misdemeanor to a felony, with penalties escalating accordingly.
Georgia's Marijuana Laws
Georgia's marijuana laws differ from most other drug possession laws. While still illegal on a federal level, many states, including Georgia, have eased penalties for possession of small amounts of marijuana (source).
